H1B Visa Holders Facing Loss Of Spousal Employment Authorizations Explore Other Options

Recently, a proposed regulation that will terminate employment authorization documents (EADs) for H-4 visa holders, was submitted to the White House Office of Management and Budget. This is the first required step in the formal rulemaking a process that could ultimately lead to the termination of the H-4 EAD program. Should this occur, the spouses of H1B visa holders, many of whom are waiting to become eligible for green cards in the U.S., may no longer be authorized to work? Commenting on the development, Jessica Collins, a U.S. Citizenship and Immigration Service (USCIS) spokesperson said, “USCIS continues reviewing all employment-based visa programs. No decision about the regulation concerning the employment eligibility of certain H-4 spouses is final until the rule making process is complete.” Assuming the final rule eventually is implemented, it is not yet clear whether existing H-4 EADs or pending I-765 applications for H-4 EADs will be canceled, but judging by the public statements of the President and a general mood of the USCIS leadership in this area, it seems likely they will….
